Our Rules

Great to have you on our page! To keep this a nice place where everyone feels welcome we do have a few rules. As it turns out they are actually pretty basic:

Terms of Service

Uploading and creating wallpapers

When you upload any images to our website, or publish any form of content through the wallpaper creator or otherwise, you warrant to us that (1) doing so does not violate any existing rights of others, (2) doing so does not violate EU or US laws, or the laws of the country you are residing in, and that (3) you are the original author of the uploaded images or do have sufficient rights over the material in question.

By uploading content to the public gallery of Dynamic Wallpaper Club (DWC), you grant DWC a non-exclusive, royalty-free, perpetual, irrevocable worldwide license (with sublicense and assignment rights) to use, to display online and in any present or future media, to create derivative works of, to allow downloads of, and/or distribute any such file or content.

When you delete your wallpapers, this license automatically terminates, but will not be revoked with respect to any file or content DWC has already copied and sub-licensed or designated for sublicense.

We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don't assume that we do.

Downloading and using wallpapers

By downloading a wallpaper from DWC, you agree that you do not claim any rights to it. You are allowed to use wallpapers and content downloaded from DWC under the following conditions:

• For personal, non-commercial use
• Anything that qualifies as 'Fair Use', e.g. in reviews, articles, videos etc. Please make sure that you attribute both the original Author of the wallpaper and DWC as providing platform/generator for dynamic wallpapers.
• Commercial use is not allowed. This can include redistribution, use in advertisements, or even commercial use on Platforms such as Youtube. If in doubt please consult legal advice.
• You use any wallpaper/image/download at your own risk. We do not make any warranties that the content is non-infringing and you will indemnify DWC from any copyright infringement claims resulting of the use of one of our wallpapers.

These terms do not grant you the right to use any branding or logos used in our Services. Don't remove, obscure, or alter any legal notices displayed in or along with our Services.

and other Removal Requests based on Intellectual Property

We value intellectual property. If you find problems with any of our wallpapers, please get directly in touch with us, either through our Telegram Group, Mail, or directly send a Removal Request.

When you send a takedown request, please include all of the following:

• Full URL and Title of the wallpaper in question
• Proof of your copyright ownership, e.g. copyright registration number or other sufficient proof
• Proof of your identity in form of a physical or digital signature
• Statement that the use in question is neither authorized through you nor a party holding the rights to grant such a use
• Statement that all your information is accurate
• A way of contacting you, in case we have further questions

Before contacting us, please consider whether the wallpaper is covered by 'Fair Use'. If we believe the wallpaper is indeed fair use, we will try to get in touch with you to resolve the situation.

Other Removal Requests

If you encounter wallpapers that violate the Terms of Service, or are against US or EU law, please do not hesitate to contact us directly through the Removal Request form. Such cases are e.g. Pornographic images, Violence, Hate speech, Swastikas, etc.

Misuse

Don't misuse our Services. For example, don't interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Notifications

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

Mobile Use

Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

You must follow any policies made available to you within the Services.
